Terms of Service

These Terms of Service ("Terms") govern your access to and use of the PHIX website and Beta program ("Service"). By registering for or using the Service, you agree to be bound by these Terms.

1. About PHIX Beta

PHIX is currently in a pre-release Beta phase. The Service is provided for testing purposes and may be incomplete, unstable, or subject to significant changes. You acknowledge that you are using the Service at your own risk.

2. Eligibility

You must be at least 18 years of age to register for the PHIX Beta program. By registering, you represent and warrant that you meet this requirement and that all information you provide is accurate and complete.

3. Beta Access and Registration

Participation in the Beta program is by invitation only. Submitting a registration form does not guarantee access. We reserve the right to grant or revoke Beta access at our sole discretion. You must verify your email address to complete registration.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to any part of the Service
• Reverse engineer, decompile, or attempt to extract source code
• Transmit any harmful, offensive, or malicious content
• Use the Service to infringe the intellectual property rights of others
• Sell, resell, or sublicense your Beta access
• Disclose or publish confidential information about the Beta software without our prior written consent

5. Beta Feedback

You may optionally provide feedback, suggestions, or bug reports ("Feedback"). By providing Feedback, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use, copy, modify, and incorporate the Feedback into our products without any obligation to you.

6. Confidentiality

The Beta software, its features, and any non-public information shared with you during the Beta program are confidential. You agree not to disclose such information to third parties without our prior written consent.

7. Intellectual Property

All intellectual property rights in the Service, including the software, design, and content, are owned by or licensed to PHIX. Nothing in these Terms grants you any right, title, or interest in or to the Service except for the limited right to use it during the Beta period.

8. No Warranty

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. WE EXPRESSLY DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, PHIX SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED EUR 50.

10. Termination

We may terminate or suspend your access to the Beta program at any time, with or without notice, for any reason, including violation of these Terms. Upon termination, your right to use the Service ceases immediately.

11. Governing Law and Jurisdiction

These Terms are governed by the laws of Germany. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of the place where PHIX's registered office is located, unless mandatory consumer protection laws in your country require otherwise.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify Beta users of material changes by email. Continued use of the Service after such changes constitutes acceptance of the updated Terms.
